Consultancy for the registration of 3 regional land alliances

Background

In December 2016, the Norwegian People’s Aid’s (NPA) Land and Resource Rights Project (LRR) facilitated restructuring of the former 10 State Land Alliances (SLAs) into three (3) Regional Land Alliances (RLAs).

The rationale for restructuring the SLAs is to enable robust coordination of the SLAs’ activities and maximize use of the minimal resources avail to the land alliances by NPA. Restructuring the SLAs to 3 would also mitigate challenges brought about by the creation of more states in the country.

The 3 RLAs are;

  • Greater Upper Nile Land Alliance (GULA),

  • Greater Bhar el gazel Land Alliance (GBLA),

  • Greater Equatoria Land Alliance (GELA).

    The 3 RLAs although are informally constituted by the members of former state land alliances, they are yet to formally register with the Relief and Rehabilitation Commission (RRC) in accordance with the provisions of the Non-governmental Organizations Act, 2016.

    This implies that they are not legally recognized under the laws of South Sudan and couldn’t freely and legally operate/conduct activities across the country.

    Thus, NPA’s LRR project is looking forward to support the registration of the 3 RLAs.

    Purpose of the Activity

    This activity seeks to register 3 RLAs with the Relief and Rehabilitation Commission (RRC) in accordance with the NGO Act, 2016.

    Objectives of the Activity

  • To gather opinions/views of steering committees and other members of the 3 RLAs in order to inform drafting of the 3 RLAs’ constitutions,

  • To write 3 constitutions of the 3 RLAs and incorporate the views/opinions collected from the members of the 3 RLAs,

  • To register the 3 RLAs with the RRC in accordance with the provisions of the NGO Act, 2016,

  • To obtain relevant letters from RRC for the 3 RLAs so that they are able to open bank accounts.

    Role and Responsibilities

  • The registration process would involve doing consultation with steering committees of each RLA. Specifically the applicant would amongst other;

  • Develop an outline of the 3 RLAs’ constitutions and put together a work plan for the registration process,

  • Conduct consultations (i.e face to face meetings, Skype calls, phone calls, email communications e.t.c) with RLAs steering committees and other members to incorporate their views into the constitutions,

  • Produce three (3) constitutions of the 3 RLAs (GULA, GELA and GBLA),

  • Register the 3 RLAs with the RRC in accordance with NGO Act, 2016 and deliver the registration certificates to the steering committee of each RLA,

  • Coordinate with NPA’s LRR staff for their guidance on the 3 RLAs’ constitutions writing,

  • Write report upon completion of the activity and share with NPA’s LRR staff.

    Deliverables

  • 3 constitutions for the 3 RLAs. One for each RLA,

  • 3 registration certificates for the 3 RLAs. One for each RLA,

  • 3 introductory letters to the bank(s) for the 3 RLAs.
    One for each RLA,

  • Work plan for the registration process,

  • Report for the entire activity (Activity Completion Report).

  • Capacity areas/experience requirements for the Applicants

  • Must be a legally registered law firm with advocates who have valid practicing licenses,

  • Must have experience in doing similar work before for at least 3 years,

  • Must have better understanding of civil society organizations’ work,

  • Must have cost effective budget,

  • Prices proposed by the applicant must include registration fee of the 3 RLAs at RRC, local transport cost in Juba and other location, meeting costs, communications costs, cost of the applicant effort/time for the work and other justifiable costs associated with this work. NPA would cover would cover travel of the applicant from Juba to Wau or to any other location outside Juba,

  • Prices proposed by the applicant will be considered fixed regardless of currencies inflations,

  • Cost relating to development of application will be cover by the applicant. NPA will not reimburse any applicant, whether successful or not for the application costs.

    Payment schedule

    The sequence of payment shall be determined during the signing of the agreement for the activity. However, full payment shall only be made upon the delivery of all the deliverables.

    Timeframe

    Closing date for the RFA: March 25, 2017.

    Starting date for the activity: March 30, 2017.

    The period of period of performance is 11 days.

    End date for the activity: April 10, 2017.

    Location of the activity: Juba, with possible travel to Wau.

    Line of communication

    The successful applicant will report to the project coordinator, Land and Resources Rights and will work closely with the Land and Resources Rights Project team to ensure timely and successful completion of the activity/assignment.
