Requirements
  • For appointment to the position of Judge of the Employment and Labour Court, applicants must possess the following minimum qualifications set out in Article 166(2) and (5) of the Constitution, namely: -
  • Hold a law degree from a recognized university, or be an advocate of the High Court of Kenya, or possess an equivalent qualification in a common-law jurisdiction.
  • Have at least ten (10) years’ experience as a Superior Court Judge or professionally qualified Magistrate irrespective of whether that experience was gained in Kenya or in another commonwealth common-law jurisdiction; or
  • Have at least ten (10) years’ experience as a distinguished academic or legal practitioner or such experience in other relevant legal field Magistrate irrespective of whether that experience was gained in Kenya or in another commonwealth common-law jurisdiction; or
  • Have held the qualifications specified in paragraphs (b) and (c) for a period amounting, in aggregate, to ten (10) years.
  • Meet the requirements of Chapter Six of the Constitution on Leadership and Intercity.
  • Notes: i. Knowledge and experience in employment and labour relations will be an added advantage;
  • In addition, the applicants must demonstrate a high degree of professional competence, communication skills, fairness, good temperament, good judgment in both legal and life experiences and commitment to public and community service.
  • The appointments shall be made in accordance with Articles 166 (1) (b) (2) (5), 162 (2) (a) and the First Schedule of the Judicial Service Act, No. 1 of 2011.

    Duties and Responsibilities
  • A Judge of the Employment and Labour Relations Court shall serve in any Employment and Labour Relations Court station in Kenya. The functions and jurisdiction of the Court is provided for under Part III of the Employment and Labour Relations Court Act, No, 11 of 2011, namely:
  • Have original and appellate jurisdiction to hear and determine all disputes relating to employment and labour relations including;
  • Disputes relating to or arising out of employment between an employer and an employee;
  • Disputes between an employer and a trade union;
  • Disputes between an employers’ organisation and a trade union’s organisation;
  • Disputes between trade unions;
  • Disputes between employer organizations;
  • Disputes between an employers’ organisation and a trade union;
  • Disputes between a trade union and a member thereof;
  • Disputes between an employer’s organisation or a federation and a member thereof;
  • Disputes concerning the registration and election of trade union officials; and
  • Disputes relating to the registration and enforcement of collective agreements.
  • Hear and determine appeals arising from:-
  • Decisions of the Registrar of Trade Unions; and
  • Decisions of any other local tribunal or commission as may be prescribed under any written law
  • Adopt and implement appropriate means of disputes resolution, including internal methods, conciliation, mediation and traditional disputes resolution mechanisms

  • A detailed and updated curriculum vitae, to include background information such as community service, financial discipline, pro bono activity, involvement as a party in litigation and involvement in political activity including financial contribution to political party
  • Parties (if any) and criminal record, legal
  • Professional engagement for the last five (5) years, three (3) professional referees and two (2) character references who can verify and comment on the applicant’s past and present employment,
  • Applicant’s three (3) recent coloured passport size photographs,
  • Five (5) samples of any professional writings, including but not limited to judgments, advocacy submissions in courts, scholarly writings or any legal publications that the applicant has authored,
  • Declaration of income and liabilities as at the time of making the application, using the prescribed forms “The Declaration of Income, Assets and Liabilities Form JSC 2b” which can be downloaded from the following website – www.judiciary.go.ke.
  • Applicants from Government employment should also attach previous copies of returns of Declaration of Income, Assets and Liabilities for the last three (3) years.
  • Those in private practice should attach audited accounts and tax returns, for the last three (3) years.
  • Certified copies of testimonials, professional certificates and academic transcripts.
  • Applicants should have valid clearance certificates from the following bodies:-
  • Kenya Revenue Authority,
  • Higher Education Loans Board,
  • Law Society of Kenya,
  • Directorate of Criminal Investigations,
  • Advocates Complaints Commission,
  • Ethics and Anti-Corruption Commission and
  • A recognized Credit Reference Bureau.
  • Shortlisted candidates will be required to carry the original clearance certificates during interview.
  • Applicants are also required to forward one (1) hard copy of the completed Employment Application Form (JSC 2 for non-public officers or JSC 2A for public officers) which can be downloaded from www.judiciary.go.ke (downloads) and to attach all the documents cited in item No. 1 (a to g)above.
  • Applicants Must take note that it is a criminal offence to provide false information and documents in the job application and the same will be verified by relevant bodies.
  • The applications must reach the Commission Not Later Than 18th March, 2019 at 5.00 P.M.
