The Consultancy

The consultancy falls within the framework of IDLO Somalia’s engagement in the “Joint Justice Programme”.

The Somali Bar Association Institutional and Capacity Development Expert will work in collaboration with IDLO Somalia’s Country Office staff, the Somali Bar Association and other Somali justice sector stakeholders including the Ministry of Justice, the Office of the Chief Justice and the Attorney General’s Office.

IDLO is supporting the Somali Bar Association to enhance operations and expand into the Federal Member States.

The Somali Bar Association was originally established in the 1960s but collapsed during the civil war.

The legal community in Mogadishu re-established the SBA in 2010. Currently, the SBA has approximately 157 members across the country (93 in Benadir, 52 in Puntland, 7 in Jubaland and 5 in Southwest).

The incumbent will report to the IDLO Country Director and work closely with the Field Program Manager and Program Coordinator.

The Consultancy will be provided over a period of four and half months from July 1, 2019 to November 15, 2019.

The incumbent will be responsible for the implementation of the following activities and deliverables:

  • Develop a draft SBA Charter, which includes:
    Through a series of consultations, develop an effective and efficient membership, governance structure, define the powers of the General
  • Assembly and oversight mechanisms for the SBA;
    Within the SBA structure, create a women lawyers’ forum and develop its terms of reference, through consultation with women lawyers;
  • Develop a roadmap for the SBA, including a milestone-based long-term strategy for the SBA;
  • Develop an institution and capacity development plan for 2 years for the SBA.
  • Build leadership capacity of the SBA, which includes:
  • Provide technical advice to the SBA leadership in reforming its structures and guide the SBA through finalizing its Organogram;
  • Identify local & international partnerships. In doing so, the Institutional Development and
  • Capacity Expert will develop a database of legal associations and legal governing bodies across Africa and the Middle East (including designated focal points and contact details) and, at the SBA’s request, facilitate introductions to the SBA;
  • Develop a template for MOUs (Memoranda of Understanding) and contracts;
  • Develop a resource mobilization strategy;
  • Develop preparatory materials for the SBA to discuss licensing for lawyers and the independence of the institution.
  • Develop 2 training manuals for SBA Lawyers on: (1) Legal Ethics and (2) Case Management (for Defense Attorneys) in Criminal Litigation, which includes:
  • Design both training manuals and training schedules, incorporating interactive learning methodologies, such as use
    of fact patterns and simulations;
  • Prepare pre-and post- training tests to assess the level of increased capacity development; and
  • To ensure that there is robust designing of the training modules it is important that the Consultant undertakes the IDLO online Training of Trainers (TOT) to familiarize with IDLO Training methodology and send the certificate of completion to IDLO (capacitydevelopment@idlo.int) before commencing the design of the trainings:
  • Deliver 4 three-day training workshops to SBA members (in Benadir, Kismayo, Baidoa and Garowe) on Legal Ethics, including submitting a trainer’s report upon conclusion.
  • Deliver 4 three-day training workshops to SBA members (in Benadir, Kismayo, Baidoa and Garowe) on Case Management (for Defense Attorneys) in Criminal Litigation, including submitting a trainer’s report upon conclusion.
  • Provide technical advice to IDLO staff during the delivery period as well as attend meetings or relevant conferences/events related to the area of the consultancy if requested.

    Education and Work Experience
  • Advanced University degree in Law;
  • Ten (or more) years’ work experience in organizational development in the justice sector;
  • Proven relevant experience in institutional design & reform, particularly in setting up and/or reforming legal associations;
  • Proven relevant experience in building cross-institutional and public-private partnerships;
  • Ten (or more) years’ work experience in legal training and skills development;
  • Proven experience in developing manuals, training packages and other learning materials;
  • Proven relevant experience in mentoring and training of trainers;
  • Proven relevant experience in developing leadership capacity, particularly on-the-job mentoring.

    Language skills
  • Fluency in written and spoken English;
  • Fluency in written and spoken Somali is highly desirable.

    Specific Technical skills and competencies
  • Highly organized, with a problem-solving attitude;
  • Strong communication and interpersonal skills, and the ability to work in a multi-cultural environment;
  • Ability to work under pressure with tight deadlines, flexibility and an entrepreneurial spirit;
  • Keen sense of ethics, integrity and commitment to IDLO's mandate;
  • Good understanding of the Somali context is an asset.
