Forum Syd is a politically and religiously unaffiliated development cooperation organisation with around 140 member organisations from Swedish civil society.

Together we work with human and civil rights, and facilitate popular participation around the globe. Forum Syd was founded in 1995 and is the largest civil society platform in Sweden.

We have offices in Stockholm, Sweden and in five other countries through which we provide direct support to local organisations on the ground.

We mediate grants from Sida (the Swedish International Development Cooperation Agency) to Swedish organisations cooperating with local partners in 70 countries.

Forum Syd also advocates for just and sustainable development.

Our work centres on enabling people to organise to claim their rights and take control of their lives; for it is only then that democracy can grow, resources can be distributed more fairly, and poverty can be reduced.

Background to Forum Syd

Forum Syd is a Swedish democracy and rights organisation with about 140 Swedish member organisations with diverse partner organisations and networks worldwide.

Founded in 1995, Forum Syd’s vision is “A just and sustainable world where all people have the power to effect change” while its mission is "to advocate for changes that contribute to a just and sustainable world; and to strengthen marginalised communities who organise to claim their rights.”

Forum Syd Hub Eastern & Southern Africa (Hub ESA) interventions are mainly centered around civil society strengthening, social accountability and community empowerment interventions with overarching objective of improving the democratic space in Kenya through fulfillment of rights, equal gender participation and sustainable use of natural resources.

To effectively achieve this, Hub ESA works with a broad range of partners and stakeholders both local and international within the different spheres of its work.

Objective

  • Forum Syd Hub ESA hereby seeks to engage a qualified legal firm to provide legal services to the organisation as and when needed.
  • Suitable firms of legal practitioners are hereby requested to submit their bid for consideration. The objective of procuring the legal firm is to provide legal assistance and advice to Forum Syd Hub ESA in all legal matters regarding its functions and the discharge of its duties in accordance with the Kenyan law. The legal firm shall provide legal assistance as and when needed.

    Scope of services

    The successful firms will be required to render legal services to Forum Syd Hub ESA in the following areas:

  • Provision of regulatory support and legal advice relating to either or collectively with regard to emphasis to Labor Relations, Employment Relations & Immigration law, Debt/funds recovery, Arbitration and any other legal support for the organisation
    Litigation and litigation support relating to areas as identified above including any other courts of law, statutory tribunals and other bodies
  • Providing legal opinion on the interpretation of high risk contracts to be concluded by the Forum Syd Hub ESA and third parties taking into account all respective legislation
  • Reviewing of any other related contract matters
  • Recovery of litigation costs
  • Defending or instituting civil actions instituted by or against Forum Syd hub ESA in any court
  • Review contract templates as well as sample of existing or past employment contracts for staff and external service providers and make recommendations for enhancing these to better reflect current developments in the legal field
  • Assist in drafting legal opinions, memoranda and other legal documents
    Conduct legal analysis and research on various legal matters as and when required
  • Annual training on emerging legal issues as well as coming up with the organisation’s Compliance Matrix/issues

    Minimum requirements

  • For the purpose of providing the legal services the Law Firm will assign a sufficient number of its partners and attorneys in the competency area required per assignment.
  • The Lead Attorney will be the leader of the team of lawyers of the
    Law Firm for the duration of the provision of the legal services by the Law Firm
  • Experience working with International Non-Governmental Organisations (INGOs)
  • Proof that the bidder has been in existence and practice for a period of at least five(5) years prior to the closing date of this request for the bids
  • Professional Indemnity Cover of not less than KSh. 10 million
  • Letter of good standing from the Law Society of Kenya

    Record of Infrastructure:

  • Confirmation of the premises from which the bidder conducts its business,
  • The bidder’s communication and documents service facilities (i.e. the lead attorney and his support staff’s e-mail address, telephone/mobile number)
  • In cases where the firm of attorneys has more than one area of service as recorded in number 3 above, all the relevant areas of service must be recorded in the bid together with the details of the relevant lead attorney
  • Possession of high quality internal quality control processes and procedures for managing the contract.
  • Possession and good practice in adhering to organizational codes of conduct (including high ethical standards)

    The Lead Attorney

  • Proof that the lead attorney (s) has at least eight (8) years’ post admission experience in the identified area(s) of; Labor Relations, Employment Relations and immigration law, Debt/funds recovery and Arbitration.
    Lead attorney’s (s) proof of qualifications and admission as an attorney.

    Curriculum vitae of the lead attorney (s) reflecting the following:

  • Qualifications;
  • Area (s) of service and years of experience in the identified area (s) of service
  • Record of attendance, i.e. record of attendance and summary of four (4) matters attended to by the lead attorney (s) under the identified areas of service in the last two (2) years prior to the closing date of this request for bids.
  • Expected documentations
  • Firms are expected to submit technical and financial bids separately. The technical bid will include the firm’s human resource allocation/capacity.
  • Quality assurrance reviews of the work
    Quality Assurance of the services provided in a form reporting to the duly nominated Forum Syd Hub ESA official adhering to agreed timeframes.

    Monitoring progress of the contracts

  • Forum Syd Hub ESA shall monitor and evaluate the progress of the assignment/s on an ongoing basis and report to the Hub Manager.
  • The Hub manager will manage day to day contractual and organisational issues with the firm, monitor implementation progress and provide progress updates to staff, Forum Syd Stockholm Office and Hub ESA board.

    Independence and objectivity of staff

  • In carrying out the work, the service provider must ensure that its staff maintains their objectivity by remaining independent of the activities they execute.

    Duration of engagement

  • The firm will be engaged for a period of three (3) years, renewable once for another three years term if its services are satisfactory.

    Pricing

  • A detailed fee breakdown structure, inclusive of the lead attorney’s fee, must be included
  • All pricing must be shown inclusive of any applicable VAT
  • The Firm will be responsible for all logistic arrangements required to complete the deliverables. Forum Syd Hub ESA will facilitate convening of meetings and site visits where necessary. All relevant expenses should be covered by the firm’s contract budget.
