Terms of Reference: Policy, Legal and Institutional Analysis Consultancy

  • The African Population and Health Research Center (APHRC) is an African-led and Africa- based international research institute committed to conducting high quality and policy- relevant multidisciplinary research. Our researchers address important development issues and challenges facing sub-Saharan Africa in areas such as education, population, health, aging, urbanization and wellbeing. Our goal is to generate evidence for meaningful action, engage with policy makers in the region to disseminate our research findings, influence policy decisions and improve the quality of life in Africa.


    About National Sanitation Policy Advocacy in Eastern Africa Project
  • Kenya, Malawi, and Mozambique have made commitments to increase investment in sanitation to a minimum of 0.5% of the country’s GDP, to facilitate Universal coverage. To ensure this becomes a reality, there are several issues that need to be addressed, including a conducive enabling environment supported by a policy framework that makes it possible for the countries to invest and accelerate access to safely managed sanitation.

  • However, the rate of growth is too slow to meet SDG expectations, and the investment in the sector must be accelerated if this was to become a reality. APHRC is implementing a 3-year National sanitation policy advocacy project in eastern Africa. The project intends to support countries to develop or review their policies, to be compliant with the Africa Sanitation Policy guidelines (ASPG) that have been developed to harmonize the process of policymaking and the best practices with regards to the content of a good policy.


    Specific Objectives of the Assignment
  • The consultant will review the existing legal, policy and institutional framework relevant to the Wash Sector, but narrow down to the sanitation sub sector at the national level, and determine whether it adequately provides a basis for the overall objectives.

  • The output of this assignment should answer if the existing frameworks are relevant to the SDGs and ASPG in each of the above countries and how it can it be improved so as to lay a solid regulatory, policy, and institutional basis for effective service delivery.

  • The consultant will review the mandate and assess the functional adequacy of the legal, policy and institutions currently responsible for sanitation at the national level.

  • The objective here is to identify gaps, or conflict or inadequacy, and propose options to address legal, policy and institutional issues highlighted in the review.

  • The output of this assignment should answer if the existing frameworks support the SDSs and ASPG, What are their mandates, specific roles, functional capacities, and how do they coordinate in carrying out their various mandates, with specific reference to the sanitation value chain.

  • The consultant will do
    a presentation on legal, policy and institutional analysis report during in-country validation workshop, or as agreed with APHRC.


    Qualification and Experience
  • Bachelor’s degree in Development Studies or related field required. A Master’s degree in the same or related fields of the lead investigator is an added advantage.
  • Evidence of having done surveys in Kenya for at least two years.
  • Knowledge and experience in other countries in Africa will be an added advantage.


    Methodology
  • APHRC expects an in-depth, evidence-based, critical analysis. The Analysis must deliver informed insights and reflections with practical recommendations.


    Deliverables
  • A study work plan and accompanying budget.
  • A comprehensive legal, legal and institutional analysis report.
  • Policy brief and country fact sheet.


    Confidentiality of information
  • All documents and data collected will be treated as confidential and used solely to facilitate analysis.
  • Interviewees will not be quoted in the reports without their permission.


    Content
  • All the required documents and reports shall be submitted to APHRC within agreed timelines and shall remain the explicit property of the organization.

    Consultancy Period
  • The period of this consultancy will be approximately 4 months.

    Management
  • The final report is subject to review and authorization by the project manager.


    Bid Requirements
    Consultants who meet the requirements of this assignment should submit an Expression of Interest which should include the following:

  • Suitability statement that expresses commitment to availability for the entire period of the assignment.
  • Cover letter of not more than one page- attached separately.
  • CVs of researcher/s, not more than 2 pages- attached separately.
  • Contact details of at least three referees.
  • Preliminary proposed policy, legal and institutional analysis process, including basic context analysis, methodology, report structure, and timeline informed by these terms of reference.
  • An indicative budget including all expected costs but broken down to demonstrate what each cost covers.
